Welcome to our November 2008 Newsletter.
In this edition:
- Definition
change for Serious Harm
The Minister of Labour has announced changes to the above definition. They are expected to be in place by the end of 2008.
What are the changes?
The injury must be a trauma, an acute illness through workplace exposure, or a chronic illness or injury requiring medical intervention. For trauma, the requirement that it is “temporary severe loss of bodily function” will be replaced by “physical incapacity", which means a person is "unable to perform their normal duties for a period of seven or more calendar days".
What does this mean to you?
There are two main impacts. First: You may need to review your Hazard Register. The HSE Act says employers must eliminate, isolate or minimise Significant Hazards, which are defined (among other things), as hazards that are an actual or potential cause or source of Serious Harm. Second: Serious Harm accidents must be reported to the health and safety section of DoL (“OSH”), division of DoL. Call us if you need help 09 535 4355.
